Lively v. Baldoni 31 - Baldoni Releases Bombshell Footage. Was Blake Lying?

Part 1 of 2. We chunk on over to the main timeline again to dissect the bar footage that was released in mid-January in an effort to refute one of the scenarios that Lively called out as inappropriate and part of the pattern of sexual harassment on set. Many claim this completely undermines Blake Lively's case. Seeing as how it's some of the only evidence we the public have access to that we haven't already digested, what can we learn if we Zapruder Film this thing?

0:00:26 Thomas: Hello, Gavelheads.

0:00:28 Lydia: It up.

0:00:28 Thomas: It is that time. Yeah. The chunk time of the month.

0:00:30 Lydia: It's a chunky time.

0:00:33 Thomas: It's a time for chunks. -parter for you for now, and then probably another two in a few days. So excited to get this out to you. How are you? How have you been? It's been a minute. I'm talking to the listeners.

0:00:46 Lydia: Man. Oh yeah. I know it's been, it's, oh,

0:00:49 Thomas: None.

0:00:49 Lydia: I thought you were talking to me because it's Been a Minute Between Us too.

0:00:51 Thomas: How are you doing? Oh,

0:00:52 Lydia: Too.

0:00:52 Thomas: You're here. How you doing. Was going to get to it.

0:00:56 Lydia: That's fine. Listeners first. I get it. I get it Yeah, I'm doing okay. I'm I'm doing all right.

0:01:00 Thomas: I'm excited to be back on the feed. You know, it's too long.

0:01:03 Lydia: It's good. It has been a long time. We had some spicy stuff leading up into this. And, you never ends with these cases. Me tell you.

0:01:10 Thomas: I'm I'm excited to get back into the thick of it. We're getting into the thick of it here the thick of the online controversy because of was released because what we're going to be talking about today it was footage That was released by Brian Friedman, allegedly making a liar out of Blake Lively. And so that's what we're going to be tackling today. It's a big deal. Is the kind of thing where it's like we have to scrutinize now every millisecond of something because it's vitally important to the case. And a big reason why a lot of people turned against Blake Lively, I think.

0:01:40 Lydia: My God. Mean, I think it is. I really do.

0:01:42 Thomas: Or they already wanted to, and this is an excuse. But no, I do think this is, you see this referenced a lot as just conventional knowledge that, well, of course, Blake Latively lied about this. And so we need to talk about what the this is. And we will do so after our usual break. We'll get more into it. Can avoid the break at patreon.com/gavelpod. That's where you can get goodies. Avoid breaks and get earlier stuff and just hang out with us. Just be friends. Just be our friend. Shoulder to cry on.

0:02:09 Lydia: Help us get through this together.

0:02:12 Thomas: Assumed that we were crying on their shoulder?

0:02:15 Lydia: Think we're all crying on each other's shoulders. I think that's what's happening.

0:02:18 Thomas: Circular shoulder crying. We each have two shoulders.

0:02:21 Lydia: Make like a big, literally a circle and wrap like our arms around.

0:02:23 Thomas: Yes, it's the way to do it.

0:02:27 Lydia: I can picture it.

0:02:28 Thomas: That's all at patreon .com. All right. After this break we'll get into the footage so On January 21, Brian Friedman shared video of the bar scene, which is, they say, unedited. Um what how it's represented and this is what I was going to say where I think things really started to turd here's some of the very chill internet it

0:02:28 Lydia: I think this could work.

0:03:00 Clip: Just in bell doni bell dony just dropped some new raw footage from the set of it ends with us that actually contradicts blake lively's claims let's dive in so now caught her into two laws. I mean, lies, two lies, sorry, two laws, two lies. Edited text messages, and now this, we have footage. So if you're willing to lie or omits the truth and now two things what else are you lying about bathtub alleged that she's a Me Too victim there. That's absurd. Person is not an honest broker. I believe her less than ever. I actually disbelieve her fully now. And

0:03:43 Thomas: Wow that's guess Blake Lively's been caught in a huge lie huh

0:03:47 Lydia: And I mean those are coming from, you creators slash journalists, depending on what you view these folks as.

0:03:53 Thomas: How loose your standards are how how many drinks you've had.

0:03:57 Lydia: Kind of like a widespread sentiment across, normal people normal people slash bots we don't know um on reddit and other places too um know here's a quote yeah I was honestly team lively until this video the gross mischaracterization of events and the absolute gaslighting from her team after that was enraging and was like a pretty pretty common um that uh let's see when the new york times article hit I initially believed blake's claims or just gave her the benefit of the doubt Who would lie about those sorts of accusations? What normal person would make up such hellacious claims and then have zero evidence to back up her accusations? And then goes on to say, but then he released his countersuit and dropped his timeline with text giving context to what occurred. The most damning piece of evidence was him showing the dance scene in full. And it was nothing like Blake described. Described.

0:04:02 Thomas: Hard to say. Yeah, Right? Yeah. There's a reason for this. I think it's something we ought to contend with. We ought to watch this footage. We oughtto see what's going on. So how don't you tell us has been represented so far what did blake say happened here?

0:04:53 Lydia: Right, from Blake's Lawsuit. Another occasion, Mr. Baldoni and Miss Lively were filming a slow dance scene for a montage in which no no sounds were recorded. Baldoni chose to let the camera roll and have them perform the scene, but did not act in character as Ryle. Instead, he spoke to Miss Litely out of character as himself. At one point, he leaned forward and slowly dragged his lips from her ear and down her neck as he said, quote, it smells so good. Of this was remotely in character or based on any dialogue in the script, and nothing needed to be said because, again, there was no sound. Mr. Baldoni was caressing Miss, it says Mr. Lively, but Miss Lively with his mouth in a way that had nothing to do with their roles. When Ms. Lively later objected to this behavior, Mr. Baldoni's response was, quote, I'm not even attracted to you.

0:05:43 Thomas: That sounds bad to me. What were your thoughts kind of the first time we went over this and we read that account yeah

0:05:49 Lydia: Very creepy. Kind of disgusting. Kind of predatory. I was reading through this and did not feel good about it um I would say that I read this and again you know as alleged by Blake I get it but this to me was really really gross um that's how I felt about it I don't know if you were a little more skeptical skeptical when you read this but I kind of took it at face value no

0:06:11 Thomas: Was yeah definitely does not sound good doesn't sound great and it's like you I think that if that happened how she said that sounds really bad and so the footage is released, though, and this interesting because Blake Lively had said that no sound was recorded, and -Blake read on that would be, ah, no sound. She thinks they didn't have sound. So she said what happened and didn't think he could call her on it. But it turns out there was a mic that was on that had the sound. And so they're releasing this footage to contradict what she says. Do you take it that way? Or was she just saying there wasn't any sound like in the film? So, yeah.

0:06:56 Lydia: It as that there's no sound in the film for this, that this is, you know, kind of B -roll stuff that they were going to use. And it specifically says for a montage. The purpose of the montage was not for dialogue, was not für sound. It was for, you know, the visual representation of their relationship. And so that's how I interpreted that.

0:07:16 Thomas: And here's another thing. Were the super secret plan, like, ah, she can lie about this because there's no sound, why would she need to say that in the lawsuit? Why would she say, ah there's no sound. That doesn't do anything. Like if, if he had sound, like in a world where there was no sound recorded. The point of this was that she's using that fact to like and rewrite what it was. Why would she say, why would, and it's not her, why Would her lawyers say no sound recorded in the lawsuit? That doesn't magically make it true. Like either it would be true or or not. Reason I say that is I there's this tendency to really read everything and scrutinize it as a conspiracy theory. And I don't think, I mean, I think that there's plenty of places where people might be stretching the truth. Don't get me wrong. We should be skeptical of every word, but there's a difference between being skeptical and reading things in light of what people may want you to think and all that, and trying to look for the super secret, you Independence. What's that fucking movie?

0:08:11 Lydia: National treasure.

0:08:12 Thomas: National Treasure Secret printed on the back of the Declaration. You know, like I feel that documentary. Yeah. I hate how much the Internet has made people think that that's what's real. Like it's just this it's this culture that feeds itself online. You Know, oh, they don't want. Yeah, they want you to think it's conspiratorial thinking where they think every little sentence is going to be a sign of the conspiracy and I'm here saying hey even if like let's just say for argument because I have no problem saying things for the sake of argument let's say that blake is lying and made this up and is taking advantage of the fact that there's no sound why would she say no sound was recorded

0:08:15 Lydia: Movie. Yeah

0:08:51 Thomas: That doesn't you don't need to say that that doesn'T make it like that you would just say oh there was a scene in which this happened yeah

0:08:58 Lydia: If interpreting it that way um which no sound was recorded that becomes the gotcha then that feels almost like don't look behind this door kind of thing like it feels very strange

0:09:05 Thomas: Or something and keep in mind I think people treat treat this as though Blake's writing it too. Keep in mind that a lawyer is writing, like good lawyers are writing that. So they'd be like, well, why? You know, like that wouldn't, that isn't, just isn't how it would happen. I know it's a small thing, but it's another thing I see where we need to look at things skeptically, absolutely, but not with an eye toward what's the super diabolical secret plan, because that's just never how it works, you know? And so I think it makes more sense to read it as she just was describing the purpose of the scene and wasn't going to be any sound, you know, it's just part of describing the facts of the case. That's so we are going in timeline order, but we have made some for amended complaints. So we read Blake's complaint kind of as one thing because we didn't want to go through a complaint and then go through entirely another one later that just has a few amendments. It didn't make any sense. Similarly, this is crucial information, folks. So in the timeline, I already said we're on January 21st, and this is actually missed a lot. Like I missed it. And I, even when we were well into prep, I kept missing that there was this one complaint that like,

0:09:54 Lydia: The yeah yeah yep

0:10:07 Thomas: You know, cause that what made all the splashes is Baldoni's first amended complaint later. But Baldoni filed a complaint against Lively on January 16th we will be going through that, but we didn't, it is, that is 170 something pages. And then the first amended complaint that came out two weeks later is like 190 pages or something like it's so a lot. So we didn't want to go through both of those separately because that's going to be absurd. We're plan is to go Through the first Amended Complaint and then we will let you know what got changed because it just seems like that's way more efficient. And but that creates creates a bit Of a weird thing with this timeline, because what we need to do is read you two paragraphs from this at all v. Lively filed on January 16th, so five days before this, and there are two paragraphs characterizing this footage. And so they released this footage five days later. So why don't you read us? So I know we're getting ahead a little bit. We're getting behind ahead, ahead behind.

0:10:17 Lydia: Plus a hundred and something pages of the exhibit yeah mm -hmm right

0:11:06 Thomas: But it's only two paragraphs and it's important. So here, why don't we have Lydia read how they described what happened here?

0:11:12 Lydia: From the complaint lively's later complaint sheds light on what this point was alluding to in this demand which at the time was baffling and upon review of the filmed evidence is unequivocally based on a lie production was filming a quote romance montage of lily and ryle on their date one of the producers played music to set the mood so the characters could slow dance lively consistently unable to take direction insisted she really liked the idea of the characters constantly talking because, as she described, she and her husband liked to, quote, keep talking and talking and taking. Baldoni, her director, and the film's assistant director, who was directing the scene, disagreed. To take his direction, Baldoni offered up that he and his wife often just look into each other's eyes silently, to which she responded, quote like sociopaths, and laughed. Laughed and shook it off, while Lively once again started talking about how she and her husband can't not talk. Baldoni said, quote, I think that's cute and complimented the couple, to which Lively responded, quote. I think it's more than cute. Continued arguing and tried to direct him for the scene while they were supposed to be in character filming the scene. At some point, Heath and another producer, Irritated, called Baldoni aside to express they can't capture the intended shot because Lively wouldn't stop talking. He was instructed to somehow get her to stop. While there was a brief verbal exchange, Baldoni, heeding the instruction of their assistant director and producers, continued to try to bring them back into character. They were acting in this montage scene, Lively continued to break character and speak as herself rather than as Lily, which was extremely confusing for Baldoni who was trying to balance directing the scene within his artistic vision while also acting in character while filming and trying to get Lively to do the same. Lively apologized for the smell of her spray tan and body makeup. Baldoni responded, quote, it smells good, and continued acting, slow dancing as he believed his character would with his partner, which requires some amount of physical touching. Took them out of character again and began to joke about Baldoni's nose, which he laughed off and joked in turn, even as Lively joked that he should get plastic surgery. Incorrectly alleges that this scene was filmed without sound baldoni was wearing a microphone and the entire exchange is captured on camera any suggestion that this scene Was filmed in any manner other than pure professionalism by baldoni is unequivocally countered with actual evidence her allegation of sexual harassment is a documented and knowingly fabricated lie

0:13:41 Thomas: Okay. Well, the thing. Went through the New York Times lawsuit, and there's no disguising the fact that I think it was a pile of crap and lies. It was just dumb. It sucked. Always going to approach things skeptically, and that doesn't necessarily mean that he would be wrong about this. It sounds like Like he has the footage at this point. She doesn't. I don't know. Like I we've got to watch the footage. I think We've Got to See for Ourselves. That certainly paints a very different picture from what she said. Why do we get into What We See Here? And then we can go from there. This footage. On just the Entertainment Tonight channel. Channel has the video. And doesn't have like any other bullshit around it, which is nice. It seems to be 10 minutes even. It starts with kind of a statement from Brian Friedman. Says, Lively's complaint alleges that during a scene, Mr. Baldoni and Miss Litely were filming for a slow dance montage. Mr. baldoni was behaving inappropriately. The following videos captured on May 23rd, 2023, clearly refute Miss Lifully's characterization of his behavior. The scene in question was designed to show the two characters falling in love and longing to be close to one another. Both actors are clearly behaving well within the scope of the scene and with mutual respect and professionalism. Are all three takes filmed of the sequence. Then what we get is, and this is, it seems to be in the footage. Like I don't think Entertainment Tonight added this. This seems to be all from Brian Friedman, we get an entry from the script, essentially. It says 40, I don't know, page 40, I guess.

0:15:10 Thomas: Exterior shot of the bar at night, Lily and Ryle slow dance in the bar, patrons around them drinking and watching sports completely in their own world. Think we'll just just have to hit play here. I'm

0:15:22 Clip: Two -person message act. There's never meant to be comedy. And I felt it there. Yeah. It's like, oh, I see it now. Are you ready, everyone? You're at the bar, something's on the screen. And then can you give us a couple cues of, like, they score?

0:15:40 Thomas: Can't really see anything right

0:15:41 Clip: Just so everyone else around us is having a moment. But is it as rambunctious as it was earlier on? No, it's never going to be because we're in slow -mo. But just they're watching you know people are watching games. We see some you know just some hands and things like that. Yeah. Thank you ready and Everybody gets and play back BACKGROUND!

0:15:41 Thomas: Now, by the way. It's like nothing. That's the assistant director there. Timely. The thing they play, I don't know. Are we going to get copyright strike for the thing they play? And apparently this isn't what's in the real movie. I don'T think it's just played for like, and I always think about that. This is played for just them while they're filming. It'S a really cool, cool, nice cover of God Only Knows and Brian Brian Wilson just died.

0:16:27 Lydia: Brian Wilson. Yeah.

0:16:27 Thomas: It's kind of interesting. I've had to, you have this in my head a million times while I'm watching this. So, so far we've seen nothing. You haven't missed anything. I don't know why, but the camera was like facing, like it was in somebody's shirt. Maybe that somebody was standing in front of it. Yeah. So we didn't, you haven't missing anything. We haven't seen anything, everything um that's the song you're gonna hear and I'll we'll fill you in with what happens here so

0:16:37 Lydia: Someone's jacket. Yeah

0:16:58 Clip: Wait, this is a little bit too slow. It's actually a little better when it's quiet. Oh, okay. You'll never need what you're doubting. I'll make you so sure.

0:17:24 Thomas: So far we've seen you know slow dancy he did like a kiss on her forehead and then he went into like kiss her on the mouth and then didn't quite um

0:17:32 Lydia: Started to go in and retreat right like that kind of move where right is that the one?

0:17:36 Thomas: Let me see here I would say he retreats more she sort of I think she okay we have to keep in mind something here which is that they are acting in a scene and there's got to be a billion and one things going through Blake Lively's mind right now. Goes to do like kind of that thing where seems he like he's going to just kiss her on the lips. She sort of responds like she's going too as well, but a bit less. So his head had made quite a movement to do that. Then he backs off. So he has kind of more space to back off. And she kind goes back to how she was. So she didn't move much, but she didn' t actually, she didn'' t retreat. I it's fair to characterize this as her backing out of it or anything.

0:17:50 Lydia: Think her face angles down though doesn't it? Like it.

0:18:23 Thomas: Let me see here. I she actually even moves her lips a tiny bit looking like she's going to kiss him back. I think this is, you are in a scene and you are an actor and everything in the world as an actor, all your impulses, all you're training, everything thing is to go with your scene partner. Like you are supposed to act as a human being would in the scenario. And that's what makes this so hard and so complicated, by the way. And hey, maybe you should have such a thing as a intimacy coordinator for this very thing.

0:18:56 Lydia: This be a great scene for an intimacy coordinator to actually be on set for you know you know yeah

0:19:03 Thomas: Wouldn't it? Really to to react to the fact that Blake Lively is acting. I'm not saying that we can for sure say in her mind right now as we're watching other evidence. Like if I were just watching this random, forget everything else, this is just footage I'm seeing of a movie or something. No indication thus far that she's not just in the scene having a perfectly fine time. Like there's just nothing yet I'm saying at all. She reacted to that kiss like she was going to kind of do it because it seemed like he was going in. And again, she is in a mindset. Acting is not like a super easy thing. Like, you know, it's, it'S tricky. There's people who can't do it at all. And to be able to do it well, you have to be immersed in the scene and react to the scene partner. And, not, you know, you don't have time to think in your brain, do, Oh, do I need to stop that? Oh, I need to back away. Like you don'T have that time to Think you're just reactive, you know? Like you'RE You're just you're you're not going to be a good actor. She can't sit there and process for a second and

0:20:00 Thomas: Be stoned still like that's not going to work, you know, and I don't mean not just in this. I mean, like in general, all her training, you know, all our training is going to be to to be kind reactive and be in the moment. And so I think it's it think it makes it very easy for people to look at this and say she's into it because she's interacting with him in that way. I just think that's not fair. I'm not saying that she's for sure not I'm not making the proactive claim that I can tell she secretly hates it right now in this moment I can't tell that from this from the minute that we've seen but you can't make the claim the other way you cannot say that because she's in this scene reacting to him in this scene you can'T claim that therefore she was into it like you just cannot make that claim right. So let's go a little further and see what happens.

0:20:44 Thomas: They're doing a spin or whatever. Dancing. Happy. Be. Seems to be. So right now he's he puts his mouth kind of around her ear a little bit and it looked like he did maybe a little Bit of a kiss, but her hair is in the way, so it's hard to tell. And she says, I think we should be talking.

0:21:14 Lydia: Um he had moved in a little bit she also changed her position So then her arms kind of went around his neck and, yeah, and changed the angle that her and her neck would be to him. And then she comes back forward and says, I think we should be talking.

0:21:21 Thomas: Interesting. That's very interesting. Let me watch that again with in mind. OK, I think that's entirely fair of you to say right there. So it seems as though. OK. I know this is audio and folks, you can watch it if you'd like. We're going to go through this like the Zapruder film. But I think we have to. I mean, honestly, this is a big claim and this is a big piece of evidence.

0:21:50 Lydia: Moved a lot of people, too. Yeah.

0:21:52 Thomas: And it's a huge piece of evident. And I'm not going to do the pseudoscience body language expert crap, but I will tell you what I see as someone who's skeptical and an actor and is, you going to be as fair as possible. First time, that first time I don't think she was was resisting anything. And, and, you know, we, we just had that exchange, you and I, this time, I think you're a hundred percent right. I think that it almost seems like he's keeping his mouth and his nose is like on her nose, kind of a little bit. And it's like, it, feels to me, it seems to me that she almost reacts as though, like you're in my mouth space too long, you know, which even as a couple is weird, you're like, all right, you'd like, I know it's a slow motion scene but this and so when he kind of moves let's see one more time he oh yep he you can tell he looks down at her mouth slightly he looks like he's going to try to kiss her and maybe he's gonna do another one of those fake outs that he did the last time which was just kind of odd like to do a like he goes to kiss er on the lips which isn't in the scene on the mouth and then doesn't because like what I don't get about that here's what's odd about that to me what are are you using that for? Like it

0:22:59 Thomas: Doesn't, maybe, in a slow motion dance scene, I don't get why you would have him going in for what's obviously a kiss on the mouth and then not, like it's a tease, I guess. I mean, is that how you're reading? Like, it could be like a teasing thing.

0:22:59 Lydia: I it can be done in a flirty way. I don't know that. Yeah, yeah. Of a little bit. Yeah. Yeah I think it's like, like meant to kind of, I dunno, get your engines going.

0:23:22 Thomas: Maybe. Yeah. It feels weird because it also feels like something you might want to clear with someone, you know?

0:23:27 Lydia: A hundred percent. Do I, think that also, I, immediately after the assistant director says as playback, you know, like that's your first move. It feels weird. Like I think normally that's something that you would lead up to and then like tease it and back off a little bit.

0:23:43 Thomas: I think it's notable. You know what I said a second ago, she doesn't have the time to stop. You Know, she's got to be an actress. She's gotto do all that. But she reacted to that first one and sort of was going to go with him. Then in the second one, maybe she's had time to think for a second and be like, what's happening? You know, because I, I really, I do not believe that we can scrutinize alleged victims to stuff to the point where they have to be superhuman in all times and places and be able to do things that humans just don't do. It's very hard to be an actor already. It's actually very difficult. And so much is going through her mind in this moment. It seems to me that maybe she had time to think like, wait, what's going on here? And he does go in for that same. Now, I tell if he's going to try to kiss her or do another one of the fake out kisses, in which case, if you've done one short, what are you doing two for? Do you need another fake out kiss in the scene like you don't? So it's it's a little weird. And he very you're absolutely right. He absolutely looks down like he's gonna do it again and goes in. You see his head go in and toward a little bit and she turns her right cheek now so that her head is to the other side of his and as you said reorients her body a bit puts her arms around him now that's interesting I you could read that a lot of the ways and again I don't want to get too much into the like I'm not trying to do body language expert thing but if my best guess would would be it look like she was very purposeful in avoiding that and putting her head up and then I feel like maybe her her actor's mind was like but this is weird what's a what's what's emotion what's the thing we could be doing that would justify where I've now put my head like how I've dodged this kiss and I'm to the side of him and it feels like she's going in for that higher embrace like a close dance thing maybe um it feels kind of awkward you know and so now she She comes back and

0:25:38 Thomas: First thing she says is, I think we should be talking. That's very interesting. That's notable, but why don'T We keep going? Because there is the claim about the smells so good part we haven't got to. Let's at least Get to There, and then we'll kind of reset. She says, I think it's more romantic if we're like talking, and talking. It's a little hard to hear because of this music, but there's subtitles, and And I guess the subtitles are by them. Think we can, I actually think we can trust them. They seem to be right. But she because it's like the moment you kiss, then we give them the thing they want to see. And JB JB says, yeah, well, the whole montage is us talking.

0:26:22 Lydia: Wasn't the whole montage is us talking is after and talking no I don't know I think it's more romantic yeah well the whole montage is us Talking and then she says because it's like the moment you kiss okay

0:26:31 Thomas: Don't I play it? And then I'll, I guess I'll. Yeah. It kind of overlaps there but um he says like absolutely like the whole montage is us talking and she's kind of saying you know don't give them the thing they want to see the moment you kiss so she's very clearly expressing that she doesn't want to be kissing right now uh let's keep going okay he said that's why almost kissing is also good good. Okay. Fair enough.

0:27:21 Thomas: And she's the way she said, yeah, too. You know, like I think it's interesting to listen to that interaction. Yeah. But we're still talking, doing some spinny stuff now. She does a funny, yeah. She's like, Hey, you can cut in if you want her. She says, but in, but yeah, like, I think she means cut in, But anyway, the sense of like, she backs away, almost um, saying, saying, Hey, Extra, you can dance with him if you want, which which is interesting.

0:27:59 Lydia: It's like a jokey moment actually between like all three of them it seems yeah

0:28:03 Thomas: It's like, oh, that guy is drunk. And so, yeah, but it is interesting OK,

0:28:10 Clip: I'm sorry. If you should ride across again where you feel right, you're still gone.

0:28:19 Thomas: So now. All right. So now this is pretty important. Now what's happened is they've had that joke. They were kind of separated because of all that stuff. And then they come back together close again. Again. She's smiling. Is not initiating anything. She just kind of, now he goes into her space and almost looks like he's going to do a kiss again. She has has turned turned head again. I can't, it's hard to interpret if she's doing that to avoid this kissing. Let me see one more time here.

0:28:35 Clip: If you If you If you If you If you

0:28:59 Thomas: Feel OK, so he sort of looks like he's going to kiss her, but he also has his hand now and it starts touching her neck and her hair. And it's hard to say if she's turning to avoid any kissing or if she it actually kind of looks like it doesn't look like she's at all going to Kiss him there. But it also looks like that the slight touch to her neck is kind of she's reacting to that to sort of like make space for that with her head a little bit. Is why the head turn, it seems to me.

0:29:28 Lydia: Yeah that's what it feels to me too watching this is that it's not her having to like reassert you know her boundaries about the kissing situation it's more I think that like is you action that he's taking she's trying to lean into it potentially And but to your point, this is all initiated by him.

0:29:45 Thomas: Yeah, and I'm just trying to describe what we're seeing for now because I know it's tough with the audio medium, but it's what we are stuck with of our whole jobs and careers and what we do. But I'm trying to make sure I'm factually describing as accurately as I can. So, he's got his hand on her neck now.

0:30:04 Thomas: Now, he is taking it it down. So that's so, yeah, this is interesting. So then he goes to the of her neck, which is away from, the other one was toward the camera. Well, okay. Well the other one was closer to the camera this one. Now he's gone to the side of her net that's away from the camera, but then it kind of opens up. So you can actually see his face at that angle a little bit, But says, let's see this. So he moves her hair from that side of her neck now.

0:30:10 Clip: I could

0:30:37 Thomas: She sort of yeah, she she then after that moves it like, you know, in her own way more. He goes in with his face all in on her neck.

0:30:37 Clip: Show nothing to you

0:30:52 Thomas: Interesting. So, yeah, he goes into her neck there with his mouth, with his nose, with this kind of his whole head. You describe what happened there?

0:30:46 Clip: So I do

0:31:01 Lydia: Think this to me is a director wanting to get varied shots. Shots. When he says, let's see this. See, interpret that as an actor is like, okay, the director is wanting to say like, maybe this would be good. You know, when we edit the whole thing together, maybe the shot will look good. And I mean, from what they filmed and what they shared here, yeah, it does look better because it opens up her face.

0:31:23 Lydia: It opens up his face. The light shines through really nicely. Think if you were just taking it from like, Like if you're just two people at a bar and someone said, let's see this and like moved your hair out of the way, that would be totally different. This feels more like, you hat on right now. Not the character, Ryle, but the director.

0:31:41 Thomas: Keep in mind that they represented that the assistant director was directing this, by the way, but yes. Okay, so that was interesting. Folks can watch for themselves. The look on her face was interesting there. I'm not sure how to interpret it, but it felt, it felt like something was there. I'll say, I don't know on that one. So he comes back. Now they're just forehead to forehead, nose to nose, smiling. She steps back doing another turn.

0:32:16 Thomas: Slow dance stuff. Typical. Like she, she has her arms around his neck. Now she says talking. This I think is pretty significant. Says, she says, and we're talking. He says, says, no, I know I just got lost. That's very interesting. Says, but I think it's nice to talk. And then she says, No, I think It's more romantic.

0:32:26 Clip: While we're Yeah, great

0:33:04 Thomas: She's saying, because because then You're like, what are they saying? And he says, Well, we have no issue talking most of the time. Oh, like most of The time of the scene of the match.

0:33:15 Lydia: I think I think between the two of them, like they've been able to talk, you as themselves and whatever reason he's getting lost in the scene and is struggling to to chat here

0:33:27 Thomas: Let me see. I'm not sure if that's, let yeah. Okay. So you're is what you're thinking. Let me know. Seems like he's just commenting on how they're both so talkative normally. But I don'T think it's like him saying he's not talkative now. I don' t think it' s actually related to now. The way I, the way I interpret this is he's sort of just finding something to respond with, A, A, because of conversation. B, because she's saying, let's be talking in the scene. So they have to be instead of doing watermelon, watermelon, peas and carrots, like saying something. And it does feel like just kind of an offhanded like, well, we have no issue talking most of the time.

0:34:10 Lydia: I agree but I also want to just keep in mind what immediately preceded this which was him again director hat went on and said can we get some scores can we Get some you know from the extras and stuff responding because the assistant director again is not not really directing, and folks to respond there. So he's stepping out of character potentially at that point. And then she's kind of, it seems like she's checking in on him because then his response is, no, I just got lost. Think now she's trying to like recenter and remind him like, hey, we just have to talk. We just haveと talk. I don't know. It seems like Like it's we've talked about it before that he's having he's wearing so many hats with this project. And I think this is actually a that we can kind of see it when you're having to do too many things.

0:35:05 Thomas: This is way too this is too many things. He shouldn't be doing this. I think that's I agree. I actually think the I just got lost might be even actually more significant than that, personally. For now, I think this is his way of she. Clearly he wants to do something different in the scene and she wants to be talking clearly. I think he is managing this interaction as well. You know, and he is, I He's not going to say, okay, yeah, I'll stop doing all the other stuff, but he's kind of going with, this is a way for him to continue the conversation. Just says, well, we have no issue talking most of the time. You know, like I, I it as that, like sort of just, he's just going along with it. Like he stopped kind of doing a lot of the, the face mouthy stuff that he was doing. And he's kind of, it seems like he's maybe gotten the message for the most part and is, is kind of standing more in place now. And then they're They're just doing that slow dancing and, you a second of silence, and he's saying they'll never know in slow motion. So, So, okay. Saying that, well, we have no issue talking most of the time is him not being able to like find something to talk about in the moment kind of thing. Is Is that what you were kind thinking?

0:36:08 Thomas: Yeah, that seems, that seemed like, especially with this next line, it seems right. Never known in slow emotion. Like, it seems like he's that's him saying, like, well, you know, it doesn't really matter what we say here.

0:36:08 Lydia: So because yeah yeah exactly like trying to like take the pressure off of himself you know yeah

0:36:21 Thomas: Just trying to make the case that, you is romantic and this invites the viewer in to be like, oh, I wonder what they're talking about. Must know what they're saying. And then, you of ironically, he does say, well they'll never find out. They're never going to find out so do have that segment of silence and it does seem like oh he you know what's interesting is he seems he to be struggling in my mind here like I think I think he was really into doing the kissy head face romantic stuff yeah and then this point I think it's I mean again watch it for yourselves he's kind of frozen a little bit he's like you know and they're just doing she seems now more comfortable she's smiley and she's been again this is acting but like she seems seems comfortable in the scene still, I guess I'll say, in of the acting. She's like, yeah, talk, talk. And he just kind of is lost. He doesn't know what to say. And so there's a second of silence. And then he says, oh, you and Ryan talk all the time. So that's him kind of trying to find stuff to talk about and going with her, you know, what she wants for that for that scene.

0:36:51 Lydia: Physical yeah yeah yeah

0:37:26 Thomas: So he barely even looks happy in this moment. Like, yeah, he actually is not even really smiling. Like he's just kind it seems like he's a bit frozen there. It's interesting. Interesting. Go back here.

0:37:29 Clip: My gosh, we don't stop Oh my god Oh my goodness We don't shut up And Emily and I have like We have these moments Staring Literally for We've done it for like five minutes It's like I think you would find it terrifying It's literally We just literally do each other And like time out on a sociopath and time stops yeah but like it's that's just how it's been for us from the beginning no we're like oh my god and they score again oh my goodness I forgot to tell you something else oh I think that's cute you guys are really cute I think it's more than cute they won the stanley cup I think is amazing yeah and then let's just do one almost like super close can you guys frame up on on

0:38:23 Thomas: Since the music wasn't going, hopefully that sound was audible to people. So, you they're talking about her and Ryan. We always like to talk. Baldoni and his wife, they like to stare at each other like sociopaths for five minutes. And so that that's an interesting interaction there. You it could Know, also be it's both of them justifying what they want the scene to be. I think in some ways like hey this is why we should be talking because in my relationship we're always talking no this is Why We Should Be Staring at Each Other and doing whatever because you know which fair enough that's yeah that happens and yeah totally happens and stuff um then he wants a close-up and this will I think end the first take and

0:38:52 Lydia: Different and they have different relationships yeah yeah Yeah.

0:38:59 Clip: The Sebastian on you just let's do like a lips are right next to each other but I think you should start talking okay I mean yeah don't give it to don't give it just keep restraint yeah right come on back and

0:39:29 Thomas: That was her so as they were doing the almost kissy thing that was for kind of doing a spin herself like out of it and I feel like that's why he's laughing that

0:39:38 Clip: They couple by the bar And the couple by the bar walk towards us, cross, who is that, no, and the

0:39:41 Thomas: Is a weird noise that

0:39:42 Lydia: Is a weird noise. I don't know that I noticed that when I first watched this because the subtitle says, oh, that is not what he's responding to. That sound, I can tell you as a woman, that sound is a man who's disappointed by not getting what he wants in that moment like

0:39:48 Thomas: Is weird yes that completely rings true to me let's

0:40:01 Lydia: I'm having like PTSD right now

0:40:03 Thomas: didn'T even notice that either and like I wow okay let's uh this is why it's a pruder film uh okay I'm gonna play that again so people can hear uh back a little bit it this is where she spins yeah

0:40:19 Clip: Couple by the bar walk toward us, no who is it, no your name, sorry, ponytail lady, and

0:40:24 Thomas: So he is lies go hot because she's spent so that's her spinning away out of what was happening and then he laughs and then they come back in pretty close again and and you know she she comes back in so it's not like it doesn't seem like you know she is she is willing to come back and pretty close but then he makes that sound that is is odd.

0:40:47 Clip: A couple by bar walk towards us cross, no no, your name sorry, ponytail lady. And then, cross this way, take your date and cross this way. So

0:40:58 Thomas: Heads together, their noses are kind of together.

0:41:01 Clip: Nosy, I even think just noses. And my nose is so big. Yes, I was hoping that we could address this. It's not too late. Just gotta shut down, we gotta call an insurance month, and just deal with that. Yeah. And then, um... Cut. Just kidding. No, it's true. That's why we hired Jenny's late, too. Our noses missed.

0:41:22 Thomas: That's an interesting thing to say, I gotta say, for both of them. But like, yeah, we'll talk about it. We'll that's The end of That first take? I think we're going to keep going. And Then I think We're going to revisit with what we've learned. You know, we have a lot to go through.

0:41:27 Lydia: Probably

0:41:35 Thomas: But yeah, that was That first Take. And we're six minutes it's out of the 10 right now. We're 60 % done.

0:41:34 Lydia: Of these moments yeah man that uh that sounds gonna haunt me though I I can literally tell you I have I've been on the receiving end of that noise I know exactly what it is yeah gross all

0:41:42 Thomas: I hadn't noticed that. The second take now okay

0:42:02 Clip: So if you're like, oh, we missed some stuff. Yeah. They know each other better than that. She's not marrying someone she doesn't know with lots of red flags. Do you know what I mean? You're like oh, okay, there's stuff that we don't know. It protects all of it. Yeah. It feels.

0:42:20 Clip: One step further, Catherine, please. Great, thank you. Let's start on action. Let's just do everyone celebrated. There's a game going on. On action. Yeah. People passing. On action, it'll just be celebration. They just scored. Ready? I'm going to get your hat in there for a second, and then I'll take it off, like I'll try to kiss you, and I'll do it. Great. Great. Is that how you want it to happen? Yeah, you know I like fun hats. Oh, that's his sticker. Good. Is it a sticker? No, there's no sticker. And they score!

0:42:48 Clip: They score! As long as there are stories about you

0:43:12 Thomas: So let's catch people up I suppose um yeah we're they're setting up for the another take there and then he has a hat on he said like oh I'll go try to kiss you and then the hat will be in the way which is interesting um so he did that and then takes the hat off and then they do another one one of the, like, kind of almost kissing, but then, now he goes for her neck, um, yeah.

0:43:29 Lydia: Lean in. Yeah. From him. From his end. And she does like a little head shake kind of, you know, flirty in the moment. Acting wise. Flirty.

0:43:40 Thomas: Seems like it. Let's see. It's like a smiling, okay, so he goes into her neck and now he's, like. Rubbing his nose on, on her.

0:43:47 Clip: Let's go another I'm not getting a beard on you today I'm probably getting a great fan on you well it's not bad it's my body makeup

0:44:02 Thomas: That was a key interaction there and we can can go through it again but why don't you why you read us again how what she said about that sorry

0:44:11 Lydia: One point, he leaned forward and slowly dragged his lips from her ear and down her neck as he said, it smells so good.

0:44:18 Thomas: Okay let me let me look at at the what the lips and the nose and all that are doing okay so we're back to where we were there she does the nod the turn her head he goes you know almost like kisses her neck it seems like Like his nose touching goes all the way back up and then to the other side of her neck.

0:44:29 Clip: Let's go another. I'm probably getting a

0:44:38 Thomas: Nose is still touching and then he kind of like releases and comes back. OK, so I think this is important because this the way she described that doesn't quite hold up here. Think we got the impression. Impression if she says he put his you was it again and then said it smells so good because that I think it's it's it's fair to say in that before seeing anything gives you a very different idea of what's going on I it sound like they're not talking for what you just and again you just kind of assume it I as a reader correct me if I'm wrong But I

0:44:38 Clip: Great fan on you. That sounds good. Well, it's not bad. It's my body makeup.

0:44:55 Lydia: Dragged his lips from her ears and down her neck as she said, yeah, it's so good, Mm-hmm, Mm-hmm, yeah. Mm-hmm,

0:45:15 Thomas: Think I think as a reader, I would have assumed like they're not really talking. But then he just like says like, oh, smells so good, like, you know, whispers. And it's pretty clear that that interaction did not happen that way. So just in case the words were hard to make out, I'll do one more time and I'll make sure to say what they said.

0:45:32 Clip: Am I getting beard on you today?

0:45:34 Thomas: Am I getting beard on you today is what the subtitle says. Do you think that's accurate? I feel like that's what he said. But and she laughs.

0:45:40 Lydia: I think so, yeah

0:45:43 Clip: I'm probably getting spray tan on you.

0:45:45 Thomas: I'm probably getting spray tan on you. You know, it smells good.

0:45:47 Clip: Sounds great. Well, It's not that it's my buddy.

0:45:59 Thomas: Then they do the almost kiss again and they do a spin. She says, well, it's not, that's my body makeup. Yeah. So I think that's, a um, very important thing to emphasize and to say that like, in particular makes Blake look not truthful and is a piece of evidence for Baldoni. I think that But yeah, think it served her well to describe it that way. I think I she probably I think the lawyers probably did the technically correct thing, but it leaves a lot out, you know, and I think she probably assumed the footage wasn't coming out or maybe she even assumed there wouldn't be sound. Finish it out. So we're 742 out of 10 minutes on the clip. I think we should finish and then kind broadly about it. So I'm not sure if anything else significant happens. Let's see.

0:46:18 Lydia: I agree mm

0:46:43 Clip: Cut. I think we got plenty. Yes.

0:46:45 Thomas: Cut. We got plenty.

0:46:46 Clip: Slow motion. It's going to be a 17-minute reel. I'll take one.

0:46:51 Thomas: So this is the third take, and

0:46:52 Clip: Amar? Amar.

0:46:52 Thomas: It's just their feet, I think.

0:46:53 Clip: Very simple stuff, but then not before.

0:46:48 Lydia: Mm-hmm. I don't

0:46:53 Thomas: I don't think anything happens here, does it?

0:46:55 Clip: I always thought she was badass. But there's no description. Set and playback and background. Set and... Playback and... Background.

0:46:56 Lydia: Remember there's

0:47:00 Thomas: What are they saying Because there's no subtitles.

0:47:05 Lydia: Subtitles.

0:47:06 Thomas: It's interesting. I wonder if they're saying anything important there. I could turn it up. I don't want to blast our ears.

0:47:12 Clip: Very Very simple... Amar... Stuff, but not... Before. Before. I always... Thought she was.... Badass... but there's no description set and playback and background I

0:47:24 Thomas: Do you think they were saying there, any idea?

0:47:27 Lydia: Sounded but there was no description is what he says at the end um yeah I'm not sure

0:47:32 Clip: Stars above you you never need to tell me I'll make you so sure love

0:47:43 Thomas: I that's interesting what is what is he saying that's

0:47:44 Lydia: Did he say I'm Not Gonna Let You Direct This is what did he say yeah

0:47:47 Thomas: That's interesting I think I'll at the risk of blowing our ears out maybe I'll pump this a bit louder

0:47:53 Clip: Stars above you you You never need to doubt it I'll I'll make make you so sure about it Who's what I'd be without you Don't crop out her heel The sparkle Thank you If you should ever leave me The life would still go on Here

0:48:07 Thomas: That's really hard huh they didn't put subtitles in for that still dancing I don't know if anything important happens here but we might as well finish it out I worth checking out out out what like the what made it to the film I

0:48:39 Clip: We go Make life a special everybody oh

0:48:57 Lydia: Like it's seriously like a couple little seconds I think from this.

0:49:02 Thomas: So from I wanted to check just just for fun I think it's relevant like what ended up in the movie um I guess we won't know like whose edit did what necessarily um tried to track it down for you know a good 30 minutes of edited out time the best we can find is one tiny little shot that I think is here let's see a right, the montage. We're montaging. Okay, there's some of the footage.

0:49:25 Clip: But I definitely wanna kiss you again.

0:49:26 Thomas: We get just one of the almost kisses. Nope, now it's gone. Now it's on something else. Now it is a different place. Oh, now we are back to that.

0:49:28 Clip: Well, THAT I can DO. Okay. Don't make me regret this.

0:49:37 Thomas: Okay, it was a little bit of the noses. It is mixed in with other footage. Now, I think that is it. Is there going to be more? Now it just goes into the sex scene.

0:49:47 Lydia: There's more oh you got there were two moments essentially

0:49:51 Thomas: Two very short, tiny moments. Because now it is just the sex scenes. I don't think it goes back, right? Oh, there's the shoes. Oh, I need to go back further, I think.

0:49:58 Lydia: It opens up yeah mm

0:50:03 Thomas: Okay, yeah, shoes. That's gone already. Now Now we're on other stuff.

0:50:00 Clip: Want to try. I want to try it.

0:50:10 Thomas: Okay. It's the stuff I just did. That's it, right?

0:50:12 Lydia: That's it the almost kiss touching his thumb to her lips and I think that's at yeah

0:50:17 Thomas: All that was in the movie was just a tiny, so the shoes for a second, and then a tiny bit of one of the almost kisses none of the next stuff made it none

0:50:26 Lydia: Smile react yeah none of the next stuff made it

0:50:28 Thomas: Of that made it um you know I shoot I a ton of stuff you don't use but I just thought that was interesting I don't know I think it might make a difference how you think about it if like you know all that next stuff was definitely used or whatever that's like oh man that needs to be there um no it seems like they just used a little bit of an almost kiss in that scene and And that's pretty that's much it. You and a little bit of an almost kiss that they split between two little parts of the montage. They use probably maybe two seconds if you add it all up, maybe just interesting. I mean, I know that's how filmmaking works, but I still think it's it's interesting. It's not as though this is not as all the stuff they were doing was important to the like. Like it wasn't, you know, obviously, because they tell us what the script said, which said Lily and Ryle slow dance in the bar, patrons around them drinking, watching sports completely in their own world. All it said. That might've been exhausting, but, uh, that was the footage. That was part one, the footage there's so much to talk about from this footage. There really is.

0:51:32 Lydia: Well exhausting but necessary I I would argue necessary there there's so much much within those, you know, ultimately 10 minutes.

0:51:40 Thomas: That sound alone. I can't believe we didn't notice that sound until both watching it at that time.

0:51:46 Lydia: It will haunt me for the rest of my life.

0:51:48 Thomas: I think that was honestly kind of a tell kind of tell I can. Yep. Can't blame someone for finding that a little weird. Can't believe so uh more of those thoughts in part two um you can get on patreon.com/gavelpod right away just to go right into it just do it um everyone else it'll be I don't know more than zero seconds from now so that's what's coming at you uh in the next episode excited to get into it thanks so much for listening everyone really appreciate you share the show tell people and uh we'll be back next time to talk about what this means all

0:52:08 Lydia: To wait. You're the best.
