0:01:22 Thomas: Okay. Continuing on. Baldoni and Mr. Heath often spoke of their previous Mr Baldoni would often reference pornography to Miss Lively. Hoping to shut the subject down, she said to him privately that she had never seen it. Later, when Mr. Baldoni was once again referencing his experiences with pornography, he revealed in front of the cast and crew that Miss Lively had never, quote, seen porn. It was an incredible invasion of her privacy to discuss any aspect of her intimate life with cast and group, much less reveal something that she had only told Mr. Baldoni to try to get him to stop talking about the subject with her. Just really crap stuff I mean this is again if true this paints a really bad picture of this set and of baldoni's conduct and heath as well I mean that's the kind of thing where if some if you're trying to talk about just as a dude how many signals that someone they doesn't want to be in the conversation do you need you know hopefully just you need like one that would be the ideal number maybe maybe one and a half but if someone if you're trying to talk to a woman about porn she says she's never seen it go ahead and take that as a signal that she's like trying to get out of that conversation and that you should not then reference that and sort of out what she said in front of more people which is further pressuring you know in that way that I was talking about before where it's like always putting the pressure on blake lively to the odd one out by not allowing this behavior and this these conversations what

0:02:43 Lydia: Right, right. I the only way and this would be like in a personal situation, not is inappropriate in a workplace. If as a you're talking about porn and a woman response, I've I don't watch porn. I've never seen porn unless she says, tell me more. Yeah. Can we look at something of it, you know, together?

0:02:55 Thomas: Is this porn that That's your speaking of which you speak. I

0:03:00 Lydia: Like, then I think it's pretty clear, like, the conversation can end there. If you are not invited to teach them about it or continue talking about it because they're genuinely curious and want to learn more or want to see something that you're interested in, that's the end of the story there.

0:03:00 Thomas: Hadn't heard about this. Certainly Hollywood is going to be full of people who are a little narcissistic, I who don't know any what I feel about Blake Lively. I have no idea. Idea. When leading to constantly bringing up really uncomfortable sexual things and not being able to read the signal that someone doesn't want to hear it, that's sexual harassment. I mean, it just is. One is just straight up. Things you wouldn't make up. If anyone's theory is that Blake Lively is making stuff up, this paragraph, Mr. Baldoni engaged in other behaviors that were shocking and emotionally distressing. For example, he claimed he could speak to the dead and on several occasions told her that he had spoken to her dead father. It was off -putting and violative for Mr. Baldoni to claim a personal relationship with her recently deceased father. Mr. Baldoni and Mr. Heath were also constantly hugging and touching cast and crew. When Miss Lively or others avoided this touching, Mr. Baldoni and Mr. Heath would retaliate by becoming irritated, cold, and uncollaborative. Result was an unwelcoming and mercurial environment for Miss Lively, her employees, and others on set. So I think this is going to really, a don't know if it depends on, but will be made a lot stronger if others are testifying and backing up this version of events. And it sounds like if Blake Lively is telling anything like the truth, there should be of witnesses to that. Unless for any reason they would feel too to participate. We'll see. A section mr baldoni objectified miss lively and other women by commenting on or criticizing their bodies as sex objects. Baldoni often referred to women in the workplace as sexy. When they expressed discomfort, Mr. baldoni would deflect or try to pass it off, which undermined Miss Lively and others concerns. For example, on one occasion that Miss Lively observed, he told a female cast member that her leather pants looked sexy when she arrived to the set. When she rebuffed his comment because she was uncomfortable, rather rather than apologizing, he brushed it off with, quote, I can say that because my wife is here today. Ms. Lively felt embarrassed witnessing this kind of commentary, as did others.

0:05:17 Lydia: That same kind of of I'm not even attracted to you. Right? That exact sort of deflecting behavior.

0:05:21 Thomas: It's along those lines, yeah. Really gross to me. Again, another person involved, so we'll see. Witnesses. Another day, Ms. lively wore a low -cut dress to facilitate breastfeeding, but had covered up with a coat. The jacket briefly popped open at one point to reveal the dress, Mr. Baldoni commented about how much he liked her outfit, which flustered Ms. Lively. Later that day, Mr. Baldoni pressured Ms. Lively, who was in her pre -approved wardrobe, to remove her coat in front of the crew and multiple background actors in a packed bar. He said that he wanted to see her, quote, onesie under the coat because it was zipped low to reveal her lace bra. Consistent with past practice, he said, I think you look sexy, in a tone that made her feel ogled and exposed. With other female cast members present, she said, that's not what I'm going for. He bristled and replied, I'm sorry, hot. Deeply uncomfortable, Ms. Lively said, not that either. Mr. Baldoni responded sarcastically, quote, I guess I missed the HR meeting and walked away. Another woman on the production spoke to Ms. lively afterward to offer empathy and to share her own similar experiences with Mr. Baldoni commenting about her in sexual terms. Again, If we're just reading this complaint, I know that we to read it. This is her complaint. We We, absolutely to consider other possibilities and be open to Baldoni's side, and we are, but this is setting up a hell of a lot of things that are very corroboratable with witnesses and others and stuff that if were lying, it would be insane. She were laying and very fine upstanding professional law firm is willing to to sign their name to something that's just lies. That Like would be insane. Odds That's of that are nil. I mean, it's just virtually zero.

0:07:05 Thomas: Having done something like this, your lawyers will ask you, know, uh, you have someone who could corroborate, they'll ask you who that is. They'll, going to ask you that. They'll have vetted this, you putting in those facts is a way of signaling how strong your case case is putting in another woman there was a witness here's other female cast members present that's that's all stuff that signals to the other side we have people who will corroborate this because if she doesn't have people who corroborated this that would be insane and it would make would have the opposite effect like if she were just making this up then the other site would say oh my gosh look at how uncredible she will be after we show that she doesn't have all these witnesses stuff. And find that very unlikely, personally.

0:07:20 Lydia: Including so -and -so. Yeah. -hmm. Yep.

0:07:45 Thomas: A result of Mr. Baldoni's behavior, on May 29th, 2023, another cast member lodged a sexual harassment complaint about Mr. Baldwin's, quote, gross and, quote. Unwanted comments toward her and others. Now we have another person a sexual harassing complaint. May 29, 2023. 23. strikes me as incredibly powerful evidence of a problem on this set and that will, I think, be easy to confirm. We get to a section where Baldoni was, according to Blake Lively, Blake Lively's weight and age in certain ways. One's interesting. See how you feel about this. The second day of filming, for example, Mr. Baldoni made the rest of the cast and crew wait for hours while he cried in Miss Lively's dressing room, claiming social media commentators were saying that Miss Litely looked old and unattractive based on paparazzi photos from the set. Miss Lively tried to reassure him that she should look authentic in the the scenes depicted in the photos, which were just after her character had been abused by her fictional husband rather than hop. Baldoni, however, appeared focused on Miss Lively's sexual appeal above all else. His lengthy outburst caused a delay in shooting, forcing an emotional scene to be shot shot haphazardly.

0:08:59 Lydia: Think that is a good point for anyone who consumes paparazzi photos to keep in mind that when they're filming TV or movies, you know, anything on set, you don't know the specific thing that they're forming that day. So commenting about how a person looks and things of that nature as a member of the public consuming this stuff that's essentially not through questionable means sometimes, it's important to keep that in mind that it's not a red carpet picture. Sure. Not a like event or something like that. Like they are trying to film a story and we don't know what that scene is. Like it could be a, you looking outfit, but it turns out they're filming like a a Halloween costume party scene or something like like it could.

0:09:47 Thomas: Dream sequence.

0:09:49 Lydia: Yeah, it could Be anything. And so people having such strong opinions and reactions to that and Baldoni in this case just a little uncharitable and reactionary.

0:10:03 Thomas: Do have to say that I'm more skeptical of this paragraph than others. Cause I feel like this is venturing into the mustache twirling, you bad guy where it's like, he's going into her trailer and literally crying about other people saying she looks unattractive. Not, again, I'm saying anything's impossible I feels a bit much to me that I'm willing obviously believe that this person seems pretty clueless uh oblivious uh that's that that's pretty far that seems for for hours stopping filming to cry know I wouldn't be surprised if his version of the conversation was a lot different yeah

0:10:32 Lydia: Yeah, I could see the conversation potentially being more like concern about negative press for the movie that's going to influence if it does well, Well, like this is this is a big movie for him, like opportunity. And so I imagine he probably felt a lot of pressure for it to go well and for it to do well. I think that maybe that could be where the emotion was tied to and not necessarily that like her not looking hot. Like, I don't know that that was an imperative for him. I think the imperative was that the movie would do well and he saw this potentially as a threat to the movie doing well and people wanting to see it.

0:11:07 Thomas: And this also strikes me that it'll It'll probably just be, he said, she said, unless there's any other, I don't hear any witness. I don'T read hear any way OF corroborating this. So I don' t know. This is one where I DON' T think this will make or break the case. I feel like this would be something that if you've established this pattern through other things, that maybe this, the jury will find this believable. Whereas if you haven't, then maybe they will, they will think, well, that sounds pretty extreme. So that's, that's just my opinion though. One of the worst things. We're back to one of the worst thing that is in here. Make matters worse, when Miss Lively tried to have a meeting with Mr. Heath and producers to discuss Mr. Baldoni's unprofessional behavior described above, that meeting turned into yet another violation. Rather than an ordinary meeting time and place, Mr. Heath arrived unannounced at Miss Lively's hair and makeup trailer while she was topless and having body makeup removed move by makeup artists. Lively told Mr. Heath that she was almost done and they could meet once she was clothed. Mr. Keith, however, insisted that if she did not allow him into her trailer to speak to him at that moment, there would be no meeting with the other producers. Ms。 Lively reluctantly agreed, but asked that Mr. Heath keep his back turned. A few minutes into the conversation, Ms. lively noticed that Mr Heath was staring directly at her while she was topless. When wanting to look at a person while speaking to them. Lively and her hair and makeup artists were all deeply disturbed by this interaction on just the second day of filming.

0:12:37 Lydia: Witnesses.

0:12:38 Thomas: This is awful. I mean, this went any, like the way Blake Lively is describing it, this is so bad. And it's such a bullshit excuse. I'll be honest, like, oh, I, my habit of looking at, but you know what you're doing. That's That's, a creep knowing what he's doing. This is how she describes it and, you she should have hair and makeup people willing to testify. You hope

0:12:58 Lydia: I also you you said like when they were doing that roundtable and he admitted to cheating on on his wife for many, many years. His like with, you sharing nudity of women to other people, you knows, his wife's birth video. But still, I that can inform how was approaching the situation and why we shouldn't necessarily take his very seriously there.

0:13:19 Thomas: Getting to some stuff that have I some insight on throughout filming mr baldoni and mr heath invaded miss lively's privacy by entering her makeup trailer uninvited while she was undressed including when she was breastfeeding her infant child often had to work while breastfeeding which she felt comfortable doing so long as she She was given the time and space to cover herself. She did this frequently because she was not given breaks to feed her baby. But Miss Lively did not expect or consent to anyone entering her private spaces while topless, exposed and vulnerable with her newborn or during body makeup application or removal. Mr. Baldoni and Mr. Heath both showed a shocking lack of boundaries by invading her personal space when she was undressed and vulnerable.

0:13:59 Lydia: Drives me insane. So first of all, this is something that I think a lot of women feel they're going back to the workplace and they are choosing to pump to provide milk for their baby. Think I think it's really important for them to take. As a California -based company, are legally required allow her to have pumping breaks as necessary. For some women, that might mean fairly frequently. When I was pumping, when I would return to work, I had three pumping breaks And my had our first kid, I would move around my pumping breaks to accommodate meeting schedules, because even though I put it on my calendar that I would be busy pumping, people would disregard that and schedule over it meetings that I felt like I really needed to be there for. And so I was accommodating in a similar way that Blake is here, it sounds like, accommodating and met their needs. And in doing so, sacrificed legal rights that are afforded to me as who was breastfeeding. Now, once had my second kid and I went back to work and was pumping, went back when he was very, very young and still was trying to pump three times a day. I had mentors at work who really encouraged me and helped me feel empowered to decline meetings that were not taking my availability into account. Now, granted, I'm not on a film set. I'm Not working under timelines like that. But I feel so sad for Blake that she didn't have someone at least offering her that perspective, even if she still opted to say, you know, no, it's all right. I don't I really don't mind, etc, etc. et cetera. She did not have that from Baldoni. She Did Not Have That From Heath. That's clear because even when she tried to take those legally legally obligated breaks to pump, they would still be part of that space. Is allowed to have private space to do those things. And for me, that call into question the self -described feminism of these men who do not respect a woman's workplace right to pump for her baby or feed her baby. Um, I question their feminism. I question there, their integrity. Gritty. I question the company's ability to follow the law in California. Of those things come into question for me. I will note there is a piece here that's footnoted that I want to call out. It says, Ms. Lively was not given proper lactation breaks by Wayfarer during filming, which sometimes stretched into six hours without a break. Filming finally broke, Ms., Lively would have to run to her trailer to breastfeed. The lack of accommodation for her need to express milk caused her to develop painful mastitis. People will brush that up and say like, oh, that's just, you know, engorgement. No, it's not. It's an infection. It is an infection that can cause a very high fever very quickly. I've experienced it. Doctor said after I realized what I had actually experienced and managed to work through it through breastfeeding, doctor said if that ever happens again, you go to the emergency room right away. Like a very serious condition that can be completely avoided in a lot of cases if you are able to feed your baby or pump to feed your baby at times when your body needs to expel milk, not expelling milk in a very like structured, thoughtful can lead to Very, very dangerous things for your body. It it frustrates me to no end that those things weren't considered, it seems, or respected or valued, especially by people who claim that you know, respect women. I this is an example that they don't.

0:17:52 Thomas: As alleged, alleged, then absolutely. It does does strike me that this talk about HR and how HR is, it's there to protect the company. So much, you know, the employee, but sometimes it does both. Growth and having a competent HR at your company that's now, you know, this is a big project. This is something I can sympathize with being a small company and kind of taking on a lot. I get that.

0:18:14 Thomas: But when you're talking millions of dollars and you're taking celebrities, like you're working with, professionals you're working with. You need to have a professional set. You need to a professional workplace. And that involves somebody who knows this stuff. Somebody not Blake, not Blake having to do this herself. You should have somebody who works in HR, who is HR or several people who know that you need to guarantee this. And this is a right. You don't mess around, especially in California. And I'm have specific experience with this. This is something that is taken very seriously and you don't mess with it as I mean, they teach you from the employer side, you don'T mess with this shit. Like you don't come close to that. You don't, you don'T, you

0:18:33 Lydia: She shouldn't have to. You don't ask them to change it. Yep.

0:18:55 Thomas: DON'T ask it. You it has to be, by the way, it HAS to be a locked room. It has to BE a room where someone is not, you can't just make the break room, the pump room.

0:18:59 Lydia: Can't be a bathroom. Mm

0:19:03 Thomas: It can't, it Has to be someplace private where like she is entitled to all these things as a breastfeeding mother in California at a workplace. And so I will be interested to see how this is corroborated. This This, is something that I don't see in the writing here. I don'T see a button. You know, it's not like, oh, and a witness said, you, you know, I can't believe you're not getting your breastfeeding time. Like I don' t, I don'' t see a lot of corroboration potential here. Who knows? I could easily imagine, you text messages contemporaneously saying, oh I haven't gotten a chance. Oh, I developed, you kNow, plenty of ways I could imagine. Re not mentioned here. Doesn't mean they don' T exist, And but it's also very serious. It's also such a it seems like a death knell to Baldoni's case if this happened as alleged. So And I will be very curious to see how this is corroborated by Lively.

0:19:48 Lydia: Yeah I mean like for me this calls into question you they know don t have this as a claim but discrimination based on off of, you or also status. Right. Like that that is something that is protected in California law. All of that could have been avoided by someone drafting the schedule in a way that would allow for her to have reasonable breaks. It just it's it such an easy thing to on the front end that just shocking to me, if true.

0:20:15 Thomas: Yeah, we'll see. This is going to be a very interesting one to keep an eye on. Mr. Baldoni also routinely degraded Miss Lively by finding back -channel ways of criticizing her body and weight, a few weeks before filming began, and less than four months after Miss Lively had given birth to her fourth child, Miss Lively was humiliated to learn that Mr. Baldoni secretly called her fitness trainer without her knowledge or permission and implied that he wanted her to lose weight in two weeks. Mr. baldoni told the trainer that he had asked because he was concerned about having to pick Miss Lively up scene for the movie, but there was no such scene. So we got to talk about, there's a footnote here. In later text messages sent to his team, Mr. Baldoni referred to Miss Lively's trainer as a damn spy and sought to plant stories to portray his concerns as being motivated by his lower back pain. Seems incredibly damning to me, where you not not only have this very thing, you have a trainer who will be able to corroborate this, you she has texts of him talking about that trainer as a spy. Say Baldoni was in the right here somehow. Don't think you would say a spy, you

0:21:25 Thomas: Would Say, wow, Ms. Lively's trainer is a liar.

0:21:25 Lydia: This is embarrassing. Yeah, yeah,

0:21:27 Thomas: Like Ms. Ms. Lively's trainer trainer made something up or misrepresented what I was saying. Seems really damning. I can't imagine how he's getting out of this one.

0:21:36 Lydia: And think, I you piece here about sought to plant stories to portray his concerns as being motivated his lower back pain. If there were a scene where like you they're doing you the dirty dancing overhead lift for example um the director and he could say hey everybody so sorry we're gonna have to change our approach here because I can't I'm concerned about my back and it's not wouldn't just be lifting Blake Lively and whatever she weighed. It would be, you know, doing anything that would put pressure on that pre -existing injury.

0:21:47 Thomas: Which, yeah. Only that, yes to all that. A perfect example of, in I my opinion and the best of my ability, applying proper skepticism. We've Got Two Realities here. We've got one in which Baldoni is asking because he's concerned about a lift. We've Got another in which he's asking because he is kind of policing her body and wanting her to look a certain way for the role. And opinion, in inappropriately asking her about her weight. Now, of those two realities is more plausible? Think about this for a moment. For one, a damn spy, I think is powerful evidence. Two, there if are really texts where talking about portraying the concerns as motivated being by lower back pain, that seems completely damning. So there's a possibility there's evidence here that just lays complete waste to his version of the story. But even not with that, are we really to believe that he has a back injury and the difference in whether he can do a lift or not will be the amount of weight she can lose in two weeks? Amount of light a human being can lose into weeks safely is especially someone already as small as she is. Might be two pounds. The difference in the lift being well I could lift x pounds but x plus two pounds not gonna work you whatever that is I don't know for blake lively 100 and something nothing 130 versus 132 or something I have no idea just a guess that's Not Real that that is Not Real real. What I could believe is real is pressuring because you want someone to look a certain way as fast as possible. That actually strikes me as something someone might for.

0:23:35 Lydia: Than four months after she gave birth to her fourth child, we know she's breastfeeding her child. Won't necessarily lose fat super quickly while you're still breastfeeding. Like your body is hanging on to a lot of mass because you You have to effectively make milk for your baby for them to grow. If you do end up losing weight too fast or too extreme or a whole variety of things, it can impact your milk production. And now you're impacting a woman's choice in feeding her baby like that's what he wanted. It was for her to lose X number of pounds over a couple of weeks just feels very unreasonable and potentially discriminatory based of that.

0:24:15 Thomas: I do think we have to realize this is Hollywood. And I think it's entirely likely that Blake Lively really wanted to lose whatever weight she could before being the star in a movie after having a kid. I think that that's something that is part of her product, you know, and I can't imagine anybody has more stake in Blake Lively's body than Blake Lively. I can'T imagine there's anybody who wants her to look better in a movie than her. A woman in Hollywood? Are you kidding me? Like, I'm sure she's on the case.

0:24:43 Thomas: And me that you could delay. Play you could uh gone with another actress I guess or you like this you want her in your movie for good reason she's gonna help your movie she's a star um up to you to work around that she's had a baby that's it just is what it is like the realities of hollywood yeah think it would be naive to pretend that like not going to be a concern about wait for a leading lady in hollywell like there is going to to be concerned. I feel like she's probably handling it as best as anyone could, you know. This will become interesting to see how this is argued over as well. And, what and, messages messages or witnesses go, what which, way. Miss Lively caught strep throat, Mr. Baldoni offered as a gift to connect her with an expert he had on retainer to help her with probiotics and to combat the sickness. When Ms. Lively went to fill out the privacy form, she saw that the expert was not what Mr. Baldoni had, represented to her, but was instead a weight loss specialist. Lively felt once again, that Mr. Baldoni was shaming her for her body and weight. Again, I would invite folks to consider like what, what this is creating, what ill will this is creating, especially again, Ryan Reynolds. I can imagine Imagine this being infuriating. I keep mentioning that because he's going to get involved. And I

0:25:52 Thomas: Just think that incredibly reasonable to me to be wanting not only Ryan Reynolds to want to get involve, but also Blake Lively to want her husband to maybe speak up for her because she's struggling to get her point across here. Like she's struggling to these, right?

0:26:07 Lydia: She's trying to advocate for herself and it's not working over and over and ever again.

0:26:09 Thomas: She needs help. Baldoni and Mr. Heath also failed to implement COVID protocols when there was a COVID outbreak on set. Ms. Lively was told by another producer that because Wayfair did not have insurance coverage COVID, Mr. Baldoni and Mr. Heath deliberately withheld from Ms. Lively that she had been exposed to COVID. Both Ms. Lively and her infant child contracted COVID from the outbreak.

0:26:31 Lydia: Awful.

0:26:31 Thomas: Yeah, that seems, I'm very curious as to that. I don't know anything about what kind of liability we're talking about for any of that. It strikes me as not really related to any of the causes of action that I see.

0:26:44 Lydia: I don't think so. So I think it's probably to the, yeah.

0:26:47 Thomas: Short of breach of contract, perhaps there's something in the actor loan out contract writer. We'll see. It'll be interesting to see how that how into it. But if true, it's it'S you another just now of evidence that this set was was not healthy.

0:26:50 Lydia: Maybe. Yeah.

0:26:58 Thomas: This was just, yeah, problematic. So this becomes important. I want to note that this is like, I what a week into filming. This been very little filming so far. And already we've got all these issues. Noting that we're not talking about like after the fact, she's listing everything that happened. This is this is all still pretty early. Under the heading Miss Lively and others lodge grievances regarding the conduct of Mr. Baldoni and Mr. Heath, which Wayfair declines to investigate. Again, this, this seems like something you could verify and something that would be very damning. Notes that Wayfaire was the employer of all the cast and crew and was thus responsible for ensuring workplace safety. Makes sense to me. Alleges like some basic stuff. There's no employee handbook. There is no, you know, none the normal like HR stuff that you have, which is interesting. I know I'm familiar with that in the workplace and like the the, URI everyday workplace, but not on a film set. It's kind of interesting. I don't know how that's supposed to work. Says Wayfair not provide Ms. Lively with information about the process and procedure for filing an HR complaint. It says to Ms. lively's knowledge, however, sorry. Lacked any process for responding to complaints about its leadership, Mr. Baldoni and Mr. Heath, who plainly were not going to investigate themselves once

0:28:14 Thomas: Again showing the problems of having all these this roles tied together in this authority tied together this uh is very very important may 26th lively told a representative of sony now remember sony is partnered for like the distribution and stuff and some and like some of the financing and this I mean this this strikes me as believable and significant and verifiable that she's wanted to express that there are problems, not just for her, for others on set as well. Looks to Wayfair. They're not going to do it. They don't even have a process. So she's like, where can I even go? I guess I'll go to Sony. She told a representative of Sony that she wanted to file an HR complaint about both Mr. Baldoni and Mr. Heath. Sony representative told Miss Lively that Sony as the distributor of the film was not empowered to control Mr. Baldoni or his behavior on set, and that such concerns must be raised with Wayfair, the studio responsible for the production. I mean, I don't blame Sony on that. It kind of makes sense. It's like, hey, we're in charge of the distribution of the film. That's not really, you know, fair Like, they're not really responsible for that. Wayfaire, Mr. Baldoni, and Mr. Heath received or were aware of a number of HR grievances regarding their conduct. For example, on the first day of filming, while attempting to hug Ms. Lively's employee, employee, Mr. Heath said, quote, I don't even know if we're allowed to do this. It's day one and we have an HR report already.

0:29:29 Lydia: Strikes me more of like a joke. The that this is set up in the complaint makes it seem like there was an H .R. report day one. I don't necessarily know that that's true. Like see it being say like it's day one and we have an H !R. Report already, you

0:29:43 Thomas: Yeah, that doesn't really, I agree with you. I think, I think this one doesn't wirklich follow. Like if they're trying to set up that, like unaware of grievances. For example, Mr Heath said I don' even know for a lot of this is day one and we haven't HR report all ready. Doesn't follow.

0:29:56 Lydia: I think what could have been stronger here and not a lawyer, but what could Have been stronger hier was that they didn't take HR potential for HR reports seriously, as evidenced by this particular quote, right, in conduct and about potential HR grievances as as a joke, related to their conduct, I but I wasn't on set and I'm not sure.

0:30:18 Thomas: That's absolutely. I think interested in why this is here. Actually, this is kind of interesting, because it they're needing to establish they've that been warned of a pattern, you know, like, so I guess I would have a worry here. Paragraph is here for that reason, and this is the best I can do, I'd be a little worried. I I don' t know how important this is, but it just seems weird. I feel like, who knows, maybe this is just some weird writing. Yeah, this strikes me more as just the pattern of not seriously enough and not having a healthy workplace. I mean, day one, you're already saying, ah, HR report. Know, another thing to consider is, and this is part of the, just sucks the about our legal system is there they're trying to pad the allegations as much as they can reasonably do. You're trying to bulletproof it so you don't get, dismissed you like a motion to dismiss. And it's possible that there's stuff where it's like, if If this is down to a he said thing, then it's going to survive a motion to dismiss because you have to take the allegations as true when you evaluate a motion to

0:31:14 Thomas: Dismiss. And so there might be some of that, like maybe this serves that function like some way. I don't know. Just speculating. Maybe some better evidence of that same point. Additionally, early in the production, another actress made a complaint about Mr. Baldoni's comments on her appearance. Mr. Baldoni expressly acknowledged her concerns in writing, stating, adjustments will be made accordingly. Yet on June 8th, that actress informed Ms. Lively that, quote, outside of anything in a scene, I actually cannot talk to Justin at all. Is very significant. Blake Lively can produce that witness, mean, come on, that's not good.

0:31:50 Lydia: Because it's over remember early in the production we're talking you May 20th May 20 something and then weeks later after he said that adjustments will be made clearly clearly nothing was done good enough for this individual based off of this quote and the time that elapsed.

0:32:08 Thomas: Is a great point, yeah. Yeah. Mr. Baldoni later expressed suspicion regarding Miss Lively's friendship with this actress as if they were colluding against him. Interested in how that's I don't know. Yeah, I don'T know what that means legally. Actually, I DON'T that might not really mean anything. It's just kind of flavor text in there. Further emphasizes that they tried to raise concerns here and they were unsuccessful. They were unsuccessful with Sony. And then we get this sentence. Huh. Weird there. There yeah

0:32:51 Lydia: Weird, because he's like proactively responding to that piece and again, the conversation happened the way that Blake's team describes it previously, she explicitly was like, wait, why are you showing me porn? That was her initial reaction. And now he's saying that I thought you wanted to see my wife's birth video. You came at me unannounced, just shoved a phone in my face where I see a naked woman. I have no context. I have no information about what's going on here.

0:33:18 Thomas: And it's like he's trying to like pre -load a defense already um this finishes out that you know they've received multiple complaints and wayfarer has not investigated them or taken them seriously or instituted protections now the the writer's strike happens and that temporarily pauses filming let's then SAG -AFTRA went on strike and definitely pauses everything. So that gives, according to Blake Lively, that gives her an opportunity to sort of sure, yeah, reset, make sure things are addressed before she comes back for filming. What we have here, everyone, is one of the worst documents you could ever possibly have in a lawsuit about sexual harassment, which is a documented meeting in Blake Lively made a 31 of all her concerns and communicated them to Baldoni, Wayfair, and Let's on November 9th, Ms. Lively's attorneys provided Wayfaire's attorney with a document entitled Protections for Return to Production. Attached is Exhibit A. I

0:34:21 Lydia: Important importantly these were things that Blake explicitly said needed to be agreed to if she were to return to the set like she will will not be back at the set until this is addressed. Yes.

0:34:33 Thomas: Going through her lawyers. Is a very serious thing. Don't know how you explain this if you're Baldoni. I truly don't.

0:34:39 Lydia: When we spoke to the employment lawyer in California, she has experience representing the business side of things, the employer side of thing.

0:34:47 Thomas: She's fully on the employer side of just in general.

0:34:51 Lydia: Said, I would never allow my client to sign this document ever.

0:34:57 Thomas: There's a little bit of confusion here. November 9th, Lively provided the, there's the 17 point list, 17 item list. We know that on November11th, says, Council for Wayfaire indicated that, quote, Wayfare, Sony, and production respectfully acknowledge that your client has concerns regarding safety, professionalism, and workplace place culture. Although our perspective differs in ensuring a safe environment for all involved is paramount, irrespective of differing viewpoints. Your outline requests, we find most of them not only reasonable, but also essential for the benefit of all parties involved. This is the 17 point list, there's also the 30 point list. And this one, it looks like wasn't signed, but it looks like when they finally were returning to work, they insisted on an all hands in person meeting. That all hands in -person meeting was attended by Baldoni, Heath, producer Alex Alex Sachs, producer Todd Black, Sony's Angie as and Ryan Reynolds, who attended at Ms. Lively's request as another designated representative, as provided for in the contract, the given subject matter of the meeting. And on that January 4th meeting, Blake Lively then had a 30 -point list. It matters, 30 this - point list wasn't the one that was signed. So things were, I guess, added in order to have that conversation. So we need to go through, at the very least, the 17 things because it's And then we can kind of compare what she added after that. So the first is any intimacy coordinator must be present at all times when Blake Lively is on set. No more messing around with that all the time.

0:36:32 Thomas: With respect to Blake Latively, any and all rehearsing, filming, reviewing of video playback or dailies and or any other interaction with any scene involving simulated sex and nudity and or partial nudity shall be restricted to those persons with essential business reasons for being present. As approved by Blake Lively and Todd Black, as further described in the nudity writer, attached a schedule one.

0:36:54 Lydia: Now, for folks, because Todd Black is a name we haven't talked about. So some people might be like, who's that? That. He is actually an producer, a producer that was added based off of the request of Blake Lively as she spoke with Sony. And this was an agreed upon person that was going to come in, a professional that that they all have high respect for. That would be a of a neutral voice potentially that Blake could lean on and also kind of help mediate any issues down the one on he he came on board as part of the 12th provision of this item that wayfarer will engage in additional experienced a -level producer approved by miss lively yes

0:37:30 Thomas: And Wayfair. So she's insisting she's that hire another producer to actively supervise the production, including monitoring the safety of the cast and crew, ensuring compliance with the schedule and overseeing logistics, problem solving, creative creative issues. So once again, strikes me as another incredibly damning thing. Has done not much filming at this point. Before the strike, she did a little bit, you know, a week or something, not much. It was so bad that she had made multiple complaints. And then through her attorneys and with her attorneys is having them not only agree to to this 17 -point list of items, but one of them is bringing on a producer specifically because of her concerns. To be more documented than most any workplace. I don't know how you explain this away. I imagine how you explained this away, especially so early in the process. They have barely even begun. So many of the complaints are about Jamie Heath. Trying to pass this off as some like dispute and thing against I mean, that's just, it's not plausible. I so we'll see how Baldoni tries to explain this, but this is really damning. I, I DON'T know how you, I Don'T know you get away from this one.

0:37:42 Lydia: Company uh

0:38:40 Thomas: Third was no spontaneous improvising of any scenes involving intimate sexual physical physical touching. Goes on, but yeah. Of the physical touching, kissing, all that must be in the screenplay up most up to date draft approved by Blake Lively, choreographed in advance in the presence of the intimacy coordinator and may only proceed as choreographED with the consent of all participants in advance. Fourth, touching and or comments on Blake Lively's physical appearance must only be done done, or made in connection with the character and scene work, not as to Ms. Lively personally. As written into the screenplay or as strictly required in connection with makeup or costume preparation, there is to be no physical touching, including hugging, of Blake Lively, her on -set personnel, and her employees. Provision, there are to be no discussions with Ms. Lively of personal experiences with sex or nudity, including as it relates to conduct with spouses or others. Sixth, no one will enter, attempt to enter, interrupt, pressure, or request entrance to Blake Lively's trailer while she is in the state of undress for any reason. Seventh, there shall be no rehearsing or filming of Blake Lively, including Blake Lively's approved body double of any nudity, partial nudity and or simulated sex, except as expressly permitted in accordance with a nudity rider. Any such footage of Blake Lively or Blake Lively body double previously shot without the nudity rider in place may not be used without Blake Lively and her legal representatives prior written consent. Tenth, there shall be no retaliation. She bolded this in the complaint. There shall be No retaliation of any kind against Miss Lively for raising concerns about the conduct described in this letter or for these requirements. Any changes in attitude, sarcasm, marginalization, or other negative behavior, either onset or otherwise, including during publicity and promotional work as a result of these requests is retaliatory and unacceptable and will be met with immediate action. They

0:40:34 Thomas: Signed this, everybody. This is something that was signed by the other side. I don't know how that works.

0:40:39 Lydia: It is the force of a contract I mean like yeah yeah

0:40:46 Thomas: We'll see. This seems pretty rock solid to me. This also seems like something where, again, if you wanted to assume for some reason that Blake Lively is going to a lot of trouble to to make all this up, this is something that the other side had the option. They had a lawyer. Wayfarer had an option of modifying or not signing this. They have said, we will sign, we agree to these provisions, or we need to modify this. They had those options. And the fact that they didn't could be a reflection of how bad of a bargaining position they were in given how bad this conduct was and how much liability they likely already had for it. 12th provision was the one that brought Todd Black on.

0:41:29 Thomas: Oh, complaint skips 13 and 14, which is weird. I don't know why they do that. Maybe just to try to, tighten you it up. You're going to have to help me understand what this is about. Wayfarer must empower any existing third -party producer with appropriate and customary authority to actively supervise the production, including monitoring the safety of the cast and crew, ensuring compliance with the schedule and overseeing logistics, problem solving and creative issues.

0:41:28 Lydia: Todd black on yeah good So my understanding of looking into the producers that were involved with this film, the vast majority of them were Wayfair employees. We're talking Justin Baldoni, Jamie Heath, Steve the other producers that are non Wayfair employees and we're putting Blake to the side. She is also a producer in that case, Alex but Sachs, who a third party producer and basically saying that she should also have appropriate authority to supervise the production, ensure safety of the cast, et cetera, et et cetera. Would have have this protection as well. So ultimately, this is to say that there are a number of producers who are not affiliated with Wayfarer Studios. They will have the same amount of authority as the Wayfarers producers.

0:42:42 Thomas: And importantly, though, for later, this last item is and creative issues, but most all of the sentence before it is about safety, schedule.

0:42:52 Lydia: Logistics. Yeah.

0:42:53 Thomas: Yeah, it's stuff that's like, don't know already, it will become important later. Mean, and creative issues is the only part of that that that looks anything like creative control or whatever. And that just doesn't look like that. Like this seems very clearly geared toward safety, onset behavior, all that stuff. Stuff so 14 which also wasn't in the complaint for some reason is about the a -list stunt double body double um and it also says to rehearse and perform any scenes involving the character lily that depicts rape or any act of sexual violence artists will only perform close-up work or other pre-approved shots for such scenes In addition, Wayfarer to engage artists approved body doubles for both characters lily and ryle for all simulated sex scenes. Cole as body double for Ryle. Wayfarer will use reasonable good faith commercial efforts to engage the same artist approved individual as artist body double and stunt double. They probably just, took you those out to shorten it a little bit. I do not see anything in there that would be any reason why you would not include it, but now we go to 15th. We are back to the complaint. Rehearsal or shooting involving Blake Lively or any other performer depicting the character of Lily that involves nudity, including partial nudity or simulated sex, must be conducted strictly in accordance with a nudity rider and must adhere to the final artist-approved script. For the avoidance of doubt, there will be no use of footage in the picture that depicts any underage character or underage actor engaged in sexual intercourse or any form of penetration note that's not blake lively so this seems like Blake Lively is trying to protect others here or trying to prevent the film from being gross

0:43:08 Lydia: -set behavior. Mm -hmm. Yeah. It's a very protective position to take. Like the

0:44:32 Thomas: In it for her other than you to protect others and maybe the film from being gross any and all day players that participate in any way in scenes with artists involving nudity partial nudity and or simulated sex must be engaged through customary industry talent agencies and not through personal connections of the director and or producer. So that speaks directly to the OBGYN incident and reminding you that Jamie Heath signed this as the president of Wayfair. Finally, 17 at Lively's election and all hands in person meeting before production resumes will include the director, the existing producers, the Sony representative, the approved producer, Blake Lively, and Blake Lively's designated representative to confirm and approve a plan for implementation of the above that will be adhered to for the physical and emotional safety of artists, her employees, and all the cast and crew moving forward. The event of any conflict between the terms and conditions of the agreement and the terms Of this side letter agreement, the terms and conditions of this side letter agreement shall control. So 17th item there talks about the meeting because was not signed until January 19th. I don't know if that matters, except to say that that meeting took place on January 4th. And that had Ryan Reynolds and others that we already mentioned because of that 17th item. That was about that meeting. And at that meeting, she has 30 concerns and these, we won't repeat any, but I think it's interesting that she had these, this 30 point list and they signed the 17 point list after seeing this 30 Point list, which guess it doesn't mean they, you speaking, signed this 30point list. I don't know if that matters, but it does mean that like signed it after seeing that and seeing that that was what she had in mind. And think that matters. It's not like they assigned it and then she's subbing in a 30 point list and trying to like say

0:46:26 Thomas: They signed that. Yeah.

0:46:26 Lydia: That it applies. Yeah.

0:46:27 Thomas: Like it's so anyway, for what it's worth, I now these 30 point items are kind of more specific specific examples of conduct. Like I think the 17 point, it doesn't really, it doesn't change a whole lot, but they're more specific. Like here are the examples we were talking about. Confusing. The complaint says at the January 4th meeting, the parties discussed a list of 20 examples of behavior. Think it has to be 30. I think t know what 20 could refer to. I mean, maybe be, it's either like some sort of like, typo or maybe somehow 20 examples plus 17. I don't know. I'm not sure. Like it might just be a typo because the list we have is 30. this is presented as what they went over on that meeting and agreed to orally. There's some really revealing stuff in this 30 point list. No nude uh videos or images of women including the producer's wife to blake lively or her employees no more mention of mr baldoni or mr heath's previous pornography addiction or blake livelihood's lack of pornography consumption no more discussion so this is just like more specific I mean it's possible who knows uh exactly but it's impossible they if they didn't understand what was happening they wanted to really make it clear like

0:47:34 Thomas: Here's here's why we came up with that 17 point list.

0:47:34 Lydia: It's based off of these yeah experiences.

0:47:39 Thomas: And so this is just, I think, a little more expansive. More discussions about personal experiences with sex. I'll skim through this kind of fast until we get to some real highlights. No more mentions to Blake Lively or her employees of personal times when physical consent was not given in sexual acts. No descriptions of their own genitalia to Blake Lively. Yikes.

0:47:58 Lydia: That's very uncomfortable, if true.

0:48:00 Thomas: More jokes or disparaging comments to be made to Blake lively and or her employees about HR complaints Wayfarer has already received on set or about quote missing the HR meeting. And think you can tell this is going to be part of the dispute. They didn't sign this 30 point list, but we know they presented this 30 -point list at the meeting that was part of this process, which they signed on to and agreed to. You know what I mean? So like, especially when lawyers are involved, if these were fabricated or something, they would have made very clear, like, hey, we need to add in writing that this didn't happen.

0:48:33 Thomas: We're not agreeing to any of this. More inquiries by Mr. Baldoni to Blake Lively's trainer without her knowledge or consent to disclose her weight. More mention by Mr. Baldoni of him speaking to Blake Lively's dead father. This is in the things they presented. Once again, emphasizing if this were made up, it can't be like, I don't even know how to finish that. More Pressing of Baldoni for Blake Lively to disclose her religious beliefs or unsolicited sharing of his. There's if Blake Lively and/or her infant is exposed to COVID again, Lively must be provided with immediate notice as soon as Wayfair or any other producers become aware of such exposure without her needing to uncover this herself days later. Intimacy coordinator must be present at all times. Okay, so that's kind of one we already got in the previous list. No more personal, we're on 12 now, no more personal physical touching, sexual comments by Mr. Baldoni or Mr. Heath toward Blake Lively or any of her employees or any female cast and crew without their express consent. No more improvising of kissing. We kind of covered that. 14 is about that other, you on set. 15, all actors participating with Blake Latively in intimate scenes involving her being in any state of nudity or simulated nudity must be classified as active working actors not quote friends of the director or producers and must be pre -approved by blake lively no more filming of any blake lively nudity without a fully executed sag compliant nudity writer in place any such footage already shot without this writer in case is in direct violation of sag requirements may not be used without Blake Lively's representatives' prior written consent Uh, we've kind of covered some of these, um, intimacy coordinator, uh, 19, no monitors to be viewed or accessible on set or remotely during closed set scenes, except by Blake Lively approved essential crew and personnel 20, no more entering, attempting to enter that. That's the trailer when she's a nude for any reason. 21, no More private multi -hour meetings in Blake Lively's trailer with Mr. Baldoni crying crying without an outside Blake Lively appointed representative to monitor. That corroborates, you least some version of that, that we talked about that I'm, skeptical of exactly that context, but at the very least we have private multi -hour meeting with Mr. Baldoni crying. So this at the meeting. You want to cry, incredibly sloppy work by Baldoni and the company's attorneys, I guess. I guess the best case that this is all just if it's all made up, they

0:50:56 Thomas: Have the worst lawyer in the world at this time. More pressing by Mr. Baldoni to sage any of BL's employees. I don't even know what that is. It's related to the religion, I suppose.

0:51:04 Lydia: Oh, I don't know that it's necessarily related to Baha 'i, but I think, you know, by that person that, like, really focuses on probiotics and all these things, I feel like he's got a lot more of that. I think that he is pretty connected to more, New age wellness industry. Is when you have like a little bundle of of and you light it on fire and helps cleanse quote, you know, helps cleanse like the body or the room of negative energy. Energy.

0:51:20 Thomas: What is saging? Yeah, would be incredibly annoying to me. Like Hollywood is pretty wooey, and I many people wouldn't have a problem with it. But if it's bothering Blake Lively enough, and her employees, by the way, because it says Blake Lively's employees, that would be annoying. 23 talks about producer Alex Sachs, and it says, to you were saying, Dang, Alex acts to be given standard rights, inclusion, and authority per her job description and as represented to Blake Lively when signing on. Sony must have an active daily role in overseeing physical production for the remainder of the film to monitor safety for cast, crew, schedule, logistics, problem creative aspects. That's interesting. Even though their response before was, oh, can't do anything, sounds like she got them to agree to to be an active part of this. Yeah. Yeah. Engagement of an experienced producer to supervise the safety of the cast and crew, schedule, logistics, problem solving, creative aspects for the remainder of the shoot. She gives examples of who would be acceptable.

0:51:46 Lydia: More ownership. Mm hmm. At that caliber kind of thing. And so they they found Todd Black to participate.

0:52:26 Thomas: 26 is the about the stunt doubles and the that one that it's pretty much the same as the other list. 27 no more adding of sex scenes we've covered that 28 no more oh here we go 28 no more asking or pressuring Blake Lively to cross physical picket lines what is that I don't remember that being alleged but must be something that wasn't wasn't I mean I guess that's not part of like a sexual harassment complaint that's so but it's but in mind this this is is more stuff that comes across as a very legitimate problem that Blake Lively set of problems was having with this set. This wasn't in, order to have a legal complaint later. I think that would be, that would Be incredibly cynical to view it that way. Of this stuff is for the safety of her, not only her, but other of her employees. And this is, this doesn't even make it into the lawsuit anywhere, asking her to cross physical picket lines. Nine, no more retaliatory or abusive behavior to Blake Lively for raising concerns or requesting safeguards. 30 is the very meeting that I think we're talking about. So that's interesting.

0:52:35 Lydia: That's the one that jumped out at me. Hm. Yeah yes. Right.

0:53:22 Thomas: that'S the 30 point list.

0:53:24 Lydia: Right. A A combination of the more like layman's language. Right. Rather than directly from the attorneys. The 17 point list is very it reads more of like a like contractual, you know, kind of agreement, whereas the 30 point list is, you knows, out the things that she needs on set, like more person to person. And here are the examples of, you Know, like, I don't want to see this anymore. I don' t want you to do this anymore." And the lawyers aren't going to be putting that in what they're asking them to sign.

0:53:29 Thomas: Like lawyers wrote it. Yeah. These two documents, particularly and again, there's kind of dispute whether or not they, quote unquote, agreed to the 30 Point list, I guess. But there's no disputing that they signed that Jamie Heath signed the 17 point list and that not much difference there's more specificity but this is very damning I don't I don' t know how you get around this okay can sort of draw this section to a close because that for now the allegations Allegations of behavior. Should note that this was agreed to. There are no further incidents that we know of that were complained about. And her complaint goes on to the PR stuff and promotion of the film. And, so we'll talk about that in the future. But overall, concluding thoughts on these allegations. What do you think?

0:54:42 Lydia: Compelling is feeling. Think so many of them reference other people in the room or in the space in which it happened. There are some that don't. I again, if you don't have witnesses for every single bad interaction, that shouldn't necessarily mean that you have no case. I think that having witnesses in some helps to then like almost that corroboration to the other examples where you're demonstrating, hey, there's a pattern. Earn.

0:55:10 Thomas: Yeah, to the point I was making earlier. Yeah, I

0:55:12 Lydia: Exactly. And so that's kind of what I walk away feeling about this. I know I went on a little rant about their Studios approach to California law when it comes to breastfeeding and my strong feelings there. I

0:55:24 Thomas: Will note actually on that topic that is not in these documents, is it? That's interesting. So that is one where I like said at the time, I would be interested in how she corroborates that. I don't actually, I'm a little skeptical of that one, to be honest, because that's a very serious issue. And for it to not be in the 17 point list or even the 30 point list.

0:55:45 Lydia: What about where it says that other producers will be involved in the schedule, et cetera, et cetera. Right. There's almost an element of like having non wayfarer producers empowered to opine on the schedule, opine on logistics. That's also an opportunity for someone else to kind of help advocate for Blake in that way, because she will continue to go on breastfeeding.

0:56:08 Thomas: All fairness, and I don't want to be in the position of arguing with you on this. In all fairness I could see this being hypothetically something that Blake Lively kind of did on her own. It might be like you did with the first workplace you were talking about, where she sort of took it upon herself to not advocate for herself. And so, therefore, there's not really much documentation or anything she can point to as to like they did this to me. But it's something she's putting in the complaint. And I would suggest that the fact that she's not putting in this list when other stuff is very specific, like other stuff, is stop mentioning my dead dad.

0:56:41 Thomas: You know, like, other stuff. This stuff is very specific. I, will say I'm a bit skeptical of the nursing complaints for that reason. I think it's also possible if she did stop breastfeeding, she might've just, it's no longer a concern. Like, and especially if this is about legitimate grievances and coming back to work and not trying to establish like a record for like some lawsuit later, like, you that's possible. I of those two things.

0:57:04 Lydia: I agree with you that I that, you kind of go with it, it's don't know that you would have anything actionable that your employer violated your rights. Right. Right. Like it's something more of like if you're insistent and then they say like cannot be accommodate as a response to that, then you have something. But think I that that's why it's more of it. Not included as a claim because it's likely not actionable based on how she approached the of the film and her rights. I just I I guess disclaimer for anyone listening. You have rights. And as as a mother returning to work and there's is not depending on what state you're in. There is nothing that your employer can do to retaliate against you for exercising those rights.

0:57:44 Thomas: Yeah, and I my final thoughts on these allegations would be these seem incredibly plausible. I there will be quibbles. I Think there could certainly be 123 items where it's like maybe there's a different interpretation. Again, we will hear from the other side. Strikes me as I feel like Baldoni is in trouble. I this much documentation. Mean, it's going to be hard. This is the best documentation, this much of, as you said, witnesses, places where people are going to be able to corroborate this and an agreement to not retaliate in any way. Like all this stuff, this looks very bad for for Baldoni. And with the acknowledgement one more time that when you read someone's complaint, it's very compelling. So have to see. We still have more to cover in terms of the PR war and all that stuff, the alleged retaliation campaign. We will eventually, we will absolutely give Baldoni's complaint the same consideration we give Lively's. But I a hard time figuring out how he's going to get out of some of this.

0:58:58 Thomas: Genitalia. Do I keep saying that? No more mentioning my dead dad.

0:59:00 Lydia: I don'T know.
